Bouncing back after the defeat of Proposition 10, the rent control measure on the 2018 ballot, rent control die-hards are gearing up to put a similar measure on the November 2020 ballot. Meanwhile, there are indications that rent control, which can readily be argued as an unconstitutional government "taking" of property, may eventually head to the US SUpreme Court for a challenge there. The recent court decision on Knick vs Township of Scott, which paved the way for property rights cases to be taken directly to federal court like any other constitutional issue, could mean that it's less expensive for property owners to challenge the illegal laws many cities are passing or trying to pass to curb property rights.
