Large real estate company sues Airbnb, claims that Airbnb does nothing to stop tenants listing units in violation of their leases. www.businessinsider.com/aimco-sues-airbnb-for-residents-illegally-subletting-units-2017-2I wonder what "reaching out to AIrbnb" meant. Did they tell Airbnb which specific listings were of properties it owned and had not given permission to be listed by the tenants? I do think that if a landlord can indicate a specific listing is its own property and cannot be rented by anyone else, Airbnb should remove the listing. However if the company just said, "You have some of our properties on your site, get them off" that isn't good enough. AIrbnb can't possibly verify ownership or legal right to sublet of all properties listed on its site. It should be sufficient that they remove a listing if the true owner calls up and demands they do that. Airbnb would remove a listing, and has removed listings, where the host rented to an Airbnb guest and the guest then turned around and listed the host's place on Airbnb with her own listing!. As I see it, when tenants list a place in violation of their lease, they are doing about the same thing as the Airbnb guest who lists the host's place without permission. Also, , fraud is committed in the same way -- people are putting up listings of property they dont' own.
