Christmas Eve Accident
Just got a message from my guests that one of them slipped and fell on the rainy deck and broke her humerus. They spent the afternoon at the hospital and are back at the apartment now. I called back and left a message and also sent them a text but no reply yet. Yikes! I'm so sad! Has anyone ever had anything like this happen? I'm out of town and won't be back until after their checkout. I'm so sad and worried, would love any advice from this group please.

What a drag. Hope they don't go after your homeowners' insurance.

I have specific vacation rental insurance with CBIZ so if it "goes there" I should be ok.. Hoping it doesn't though! Ugh

Oh that's horrible Deb! There's nothing you can do at this point but it must be frustrating not to hear back from them. Maybe you have by now. Nothing like this has ever happened to me. Good luck!

I'm sorry to hear about that. I can imagine how worried you must be! What a terrible thing to happen right at Christmas!
Please keep us posted and let us know how this turns out. Hopefully the guest has health insurance of her own and will get adequate care, and won't try to sue you or put a claim on your homeowner's policy. Really for anyone with adequate health insurance that alone should cover them. Breaking a bone is not a minor thing but neither does it cause a permanent disability.

Some unfortunate things, which are beyond our control as hosts, do happen...sometimes at the most unfortunate times (like in this case, during the holidays and while you are away!) We can definitely empathize with you.
To my understanding, the deck was wet from rain which is a natural occurrence/a fortuitous event, and not due to negligence on your part (for example, you leaving the deck wet from mopping), which could give them reason to sue you. Thankfully, you are insured, which will cover you if they decide to file a claim. Hopefully they do not.
You should definitely keep in touch with them and let them know of your concern for them. Definitely ask them if there's anything you can do to help. Hopefully they will understand that this was really beyond your control. An accident in our place has never happened to us before, but knowing that these things can happen is the reason we are also covered by insurance, just in case it does.

oh my, terrible news. I'd agree that staying in contact is the best course of action right now so that you don't seem ambivalent about it. I'd also check that deck surface to see if there's anything that can be done to make it less slippery when wet... I know that deck stain becomes slippery and you may want to consider placing some sort of step skids or if painted, consider painting with a non-slip paint (or put fine sand in the paint to get a non-skid surface)....

After several messages back and forth we has a very pleasant chat this morning. I was relieved that her attitude is positive, that she had a good experience at the ER, that her girlfriend is a doctor and she made no mention of fault. It was during a deluge of rain so it seems to be a pure accident. Regardless we will be relocating the garbage/recycling bins and putting in skid strips on the decked path. The best part is she mentioned she would like to return again. Keeping my fingers crossed that the situation stays positive. Looks likely. Phew!

Great news, Deb! Glad to hear it. It is always such a relief when we find people who still believe that accidents happen. So many now don't believe there are accidents at all anymore, only bad things where someone is to blame.

In Australia home insurance will not cover paying guests hope you gave the proper insurance cover next time the person may sue and u need the cover

Yes, we have specific vacation rental insurance through CBIZ. We are also fully licensed and have the business under an LLC. These details provided peace of mind through this experience. I'm still a bit worried about a potential lawsuit, but they remain friendly so I'm hoping for the best. Mostly I'm hoping for a speedy recovery for a kind guest who had some bad luck during a special holiday.

Deb, I'm setting up my LLC for this and another couple of business ventures I am starting. How are you finding it's working for you? What kind of license(s) did you have to get to be "fully licensed" as you mention?

Fiona, the LLC is painful during setup and tax time. But the peace of mind it gave during this crisis was invaluable!
