Hey everyone. I'm new to the group and live near _________. My HOA just sent me a letter that renting rooms is against the ccnrs. I'm one of several that do this here and have been quite successful. I'm looking for tools experience and advice. The issue is around zoning for single family use if lots.

Hi Rick. If you haven't already done so, I suggest you get a copy of the CCNRs and read carefully what it says about short-term rentals, and what the consequences are of violating that provision, if any. You should carefully weigh the value of home sharing to you versus the consequences of breaking any applicable CCNR rule. I've seen some CCNR rules that impose a mild fine. Some hosts are happy to pay that. CCNRs (contractual rules imposed by the HOA, i.e. owners) are a different issue to zoning, which are local ordinances passed by local governments. If there are several owners in your HOA who are also hosting, you may want to have a meeting of fellow hosts, consider how the relevant CCNR rules can be changed and lobby for that change. Since you are near Yosemite, there could be a majority of owners who will support such a change to permit hosting given the importance of tourism to the local economy, especially if you make the argument that such a change may increase the value of their home.

Thanks Peter. Read all that and escalated to Airbnb legal, so to be clear I"m looking for strategies to tee up to the board. specifically anything that has worked. I've already started on all the paths you suggest, now I"m looking for proven facts so anyone that has em send them to me. I will keep you updated on my progress and I very much appreciate the help. All the arguments that have been suggested I"ve already mentioned in my letter to the HOA. Many thanks.
