70 yo New York tenant in rent controlled apartment to be evicted after Airbnb-ing out her apartment.

"Her landlord, Shari Lynn Goldstein took the first steps to evict the woman in 2012, claiming that Lipetz was unlawfully profiting from her rent-stabilized apartment, that according to Street Easy is worth roughly $2million if purchased or $5,700 per month if rented.
A rent-stabilized tenant such as Lipetz can sublease an apartment for no more than a 10 per cent premium, according to the New York law.
But the five judges in Manhattan's Appellate Division First Department found that Lipetz own rent per day was $57.80, which means the elderly woman turned a 72 per cent profit. "
"A Manhattan judge has ruled that an elderly woman who made a hefty profit on her rent-stabilized Fifth Avenue apartment through Airbnb can be evicted.
The 70-year-old woman claimed that she needed a roommate to help her keep her $1,758 per month apartment of 43 years.
The former fashion and interior designer charged roughly $95 per night for one person and $120 for couples.
According to the ruling by a mid-level appeals court, Lipetz had at least one Airbnb guest for 388 days over 18 months where she collected $33,592 in profit.
"'We are mindful of the fact that defendant's age and health status naturally evoke sympathy,' Justice Peter Tom wrote for the majority.
'However, it is simply undeniable that…she exploited the governmentally-conferred privilege of her rent-stabilized tenancy to take financial profits unavailable to her landlord.' "
