In California, if you live in your home and rent to only ONE renter in your home (and you rent a bedroom to them, not an entire apartment) then you can evict them at any time, for any reason, with 30 days' notice, and without going to court. You do not have to file an eviction or unlawful detainer lawsuit. See this website for a summary of such info: www.dca.ca.gov/publications/landlordbook/whois.shtmlSee the Single Lodger law in California Civil Code section 1946.5, and Penal code 602.3 leginfo.legislature.ca.gov/faces/codes_displaySection.xhtml?lawCode=CIV§ionNum=1946.5. NOte however that police may not enforce this law and you will have to do the eviction yourself, such as by locking the guest out. Note too, if you have more than one guest you are renting to, and only one of them is troublesome, you can wait until the other leaves, and then evict the remaining one using the SIngle Lodger law.
