Need your help.
Guests who stayed in my apt last week...
- were loud (have SFPD report)- smoked weed and cigarette (crumbs on the floor)
I've asked for $200 fee for breaking my house rules through airbnb and ... the guests sent me this message.
"Via my attorney,
As a result of you illegally subletting your apartment, Under Chapter 41a of the SF Administrative Code, I, Michael Angel****, am going to request with Air BnB a full refund of my stay. In Violation of this this law by one (Taehae) I, Michael Angelo*** and guest, were subjected to harassment by the Subleaser (Taehae), Essex Fox Plaza Security and San Francisco Police Department without prior knowledge of the illegal activities being conducted at this place.
I fully written complaint by Michael Angelotti will be submitted to Air Bnb if additional charges of two hundred dollers are not removed and a full refund of four hundred and forty-two dollars is not received."
I am so upset.. These guests totally ignored my house rules and stayed in my apt and they are using the law to fight me to get their full refund.
How should i react to this ?

So sorry to hear of your ordeal. Here's what I would do if I were in your position: (1) contact Airbnb immediately and give your side of the story. Tell them the Guests are trying to blackmail you after breaking your house rules. (2) Tell Airbnb not to give a refund and ask that they consider removing the Guest's account from Airbnb. (3) Send to Airbnb a copy of your police report. I doubt whether your Guests will take this matter any further legally. It will cost them way more in attorney fees than the rental they can recover from you. On the other hand, they may be able to make your life difficult with the City Planning Department if they file a Complaint, or with your landlord (if you are a tenant) if your lease or HOA rules do not allow short-term rentals.

I think I am dealing with a mental patient.. I asked him how did he get reported for loud noise and he says "My mamacita gets wild when she's wet."
So... I've decided to drop $200 request so i don't have to deal with him anymore. I am too stressed out. He is totally blackmailing me... My building management is aware of this short term rental and they've given me a warning so i won't be evicted or anything but... this is so unfair..The guest should be removed from airbnb and I've asked airbnb to do so.. His name is Angelo*** Mich*** and he calls himself an artist. Watch out for him..

I think everyone got the letter renting on Essex properties, if they found you have an Airbnb listing. I got the letter of 3 day quit or cure.

Chalk this one up as a loss and let it go. In the future, screen potential renters by checking their previous reviews, and if there are none, don't be afraid to use the decline option.

He had 2 positive reviews and he was really good at responding quickly. I've moved on though! He was very annoying but things happen and still love airbnb. Thanks
